Terms of Service

Welcome to Pulse Tennis ("we," "our," or "us"). Pulse Tennis is developed and operated by Eddy Castro as an independent developer.

By downloading, accessing, or using the Pulse Tennis iPhone and Apple Watch application (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

1. Description of Service

Pulse Tennis allows you to track and score tennis matches from your iPhone and Apple Watch, review match history and performance statistics, optionally log workout sessions to Apple Health, and access AI-powered coaching features.

2. User Data and Local Storage

The App does not require you to create an account to use its core features.

Local Storage

Data entered into the App (including player names, opponent names, scores, match history, and match statistics) is stored locally on your device using Apple's local storage frameworks.

If you use AI Coach features, selected match information and derived statistics may be transmitted to our backend service and AI service providers to generate the requested coaching analysis.

Data Responsibility

You are solely responsible for your data. We cannot recover your data if your device is lost, damaged, or if the App is deleted.

Health Data

With your permission, the App writes workout data to Apple HealthKit. You may revoke this permission at any time through your device's Settings app. Revoking access will prevent the App from logging new workouts but will not affect previously recorded sessions in the Health app.

3. In-App Purchases and Subscriptions

Pulse Tennis offers a free tier with a limited number of matches, a one-time Pro unlock, and an optional auto-renewing AI Coach subscription.

One-Time Purchase

The Pro unlock is a non-consumable, one-time in-app purchase. It is not a subscription and does not auto-renew. You pay once and own the Pro upgrade forever, including Family Sharing where available. Pro does not include ongoing AI Coach subscription access unless explicitly provided through an offer or promotional entitlement.

AI Coach Subscription

The AI Coach subscription provides access to AI-powered match analysis, weekly summaries, trend coaching, and opponent scouting features. AI Coach may be offered as monthly or annual auto-renewing subscription plans.

Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period. Your Apple ID account will be charged for renewal within 24 hours before the end of the current period, at the then-current subscription price shown by Apple.

You can manage or cancel subscriptions in your Apple ID subscription settings. Deleting the App does not cancel an active subscription.

Billing

Purchases and subscriptions are billed through your Apple ID via the Apple App Store at the price displayed at the time of purchase. We do not process payment cards or billing information directly.

Restore Purchases

If you reinstall the App or use a new device, you can restore eligible purchases and subscriptions at no cost by tapping "Restore Purchases" in the App.

Refunds

Refund requests are handled directly by Apple according to their policies. We do not process refunds directly.

AI Coach Availability

AI Coach features depend on network connectivity, purchase validation, backend availability, and third-party AI services. We may update, limit, suspend, or discontinue AI Coach features if needed to maintain service quality, comply with law, prevent abuse, or manage operational requirements.

Apple Disclaimer

Apple Inc. is not a party to these Terms of Service and is not responsible for the App or its content. Any claims relating to the App must be directed to us, not Apple.

4. Intellectual Property

Your Content

You retain all rights to the match data and information you create using the App.

App Ownership

We own the App, including its source code, design, interface, and trademarks. You may not reverse engineer, decompile, or attempt to extract the source code of the App.

5. Prohibited Uses

You agree not to use the App to:

• Violate applicable laws or regulations
• Infringe upon the rights of others
• Attempt to tamper with, hack, or reverse engineer the App or its purchase validation mechanisms
• Abuse, overload, scrape, or attempt to bypass limits on the AI Coach service

6. Disclaimer of Warranties

The App is provided "AS IS" and "AS AVAILABLE" without warranties of any kind. We do not guarantee that the App will be error-free, secure, or uninterrupted. Score tracking is provided as-is; always verify scores with your actual match. AI Coach insights are informational and educational only and are not a substitute for professional coaching, medical advice, or your own judgment.

7. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, profits, or business opportunities arising from your use of the App.

8. Changes to These Terms

We may update these Terms from time to time. Any changes will be posted on this page. Continued use of the App constitutes acceptance of the updated Terms.

9. Legal Compliance

You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

10. Third-Party Beneficiary

You agree that Apple Inc., and Apple's subsidiaries, are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.
