Terms of Service

Welcome to Hushform ("we," "our," or "us"). Hushform is developed and operated by Eddy Castro as an independent developer.

By downloading, accessing, or using the Hushform iPhone and iPad application (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

1. Description of Service

Hushform is a premium algorithmic noise machine designed for sleep and focus. The App generates ambient sounds — including white noise, pink noise, brown noise, fan, rain, and ocean-like textures — entirely on your device using real-time audio synthesis. No audio files are streamed or downloaded.

2. User Data and Local Storage

The App does not require you to create an account to use any of its features.

Local Storage

Your preferences (such as your last selected sound, depth/warmth setting, and timer choice) are stored locally on your device using Apple's standard storage frameworks. This data never leaves your device.

Data Responsibility

You are solely responsible for your data. We cannot recover your preferences or settings if your device is lost, damaged, or if the App is deleted.

3. In-App Purchases

Hushform offers a free tier with core sounds and timers, and a one-time Pro unlock that grants access to all sounds, extended timers, and advanced depth control.

One-Time Purchase

The Pro unlock is a non-consumable, one-time in-app purchase. It is not a subscription and does not auto-renew. You pay once and own the Pro upgrade forever, including Family Sharing where available.

Billing

Purchases are billed through your Apple ID via the Apple App Store at the price displayed at the time of purchase. We do not process payment cards or billing information directly.

Restore Purchases

If you reinstall the App or use a new device, you can restore your Pro purchase at no cost by tapping "Restore Purchases" in the App's Settings.

Refunds

Refund requests are handled directly by Apple according to their policies. We do not process refunds directly.

Apple Disclaimer

Apple Inc. is not a party to these Terms of Service and is not responsible for the App or its content. Any claims relating to the App must be directed to us, not Apple.

4. Intellectual Property

App Ownership

We own the App, including its source code, design, interface, audio algorithms, and trademarks. You may not reverse engineer, decompile, or attempt to extract the source code of the App.

5. Prohibited Uses

You agree not to use the App to:

• Violate applicable laws or regulations
• Infringe upon the rights of others
• Attempt to tamper with, hack, or reverse engineer the App or its purchase validation mechanisms

6. Disclaimer of Warranties

The App is provided "AS IS" and "AS AVAILABLE" without warranties of any kind. We do not guarantee that the App will be error-free, secure, or uninterrupted. The audio generated by the App is intended for relaxation and focus purposes only and is not a substitute for medical treatment or professional advice regarding sleep disorders.

7. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, profits, or business opportunities arising from your use of the App.

8. Changes to These Terms

We may update these Terms from time to time. Any changes will be posted on this page. Continued use of the App constitutes acceptance of the updated Terms.

9. Legal Compliance

You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

10. Third-Party Beneficiary

You agree that Apple Inc., and Apple's subsidiaries, are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.
